Referral policy

Cozy Stay is an IoT enabled coliving space endeavouring to provide quality comfort and state of the art amenities with instant move-ins. This referral policy is laid down to regulate how the referral programme works, what benefits a user may avail and prohibitions with respect to the programme. You agree that You have read, understood and agreed to be bound, including without limitation, by this referral policy, the Website’s Privacy Policy and such other adjacent rules, guidelines, policies, terms and conditions as are relevant under the applicable law(s) in India and other jurisdictions, for the purposes of accessing, browsing or transacting on the Website, or availing any of the Services, and such rules, guidelines, policies, terms and conditions shall be deemed to be incorporated into and considered as part and parcel of these Terms.

For the purpose of this referral program:

An existing user of the Cozy Stay App/ Website who invites his/her friends to download and use the Cozy Stay App by sharing his/her referral code/link shall be termed as the Referrer

A new user who downloads and signs-up with the Cozy Stay App for the first time on a device on which Cozy Stay was not installed earlier, OR log-in through Cozy Stay Web application i.e. www.cozystay.co.in after using the referral code of an existing Cozy Stay App / Cozy Stay Website user shall be termed as the Referee/Referral.

The referral program shall work on the following terms and conditions:

  1. Only the existing user (of the Cozy Stay App / Cozy Stay Website can refer to the referral link. If you are not a user of Cozy Stay then, you are first required to register by log-in through Cozy Stay App / Cozy Stay Website. After you have completed your registration you can start referring to your friends/ relatives etc.
  2. Once you share the referral link of the Cozy Stay app / Cozy Stay Website via SMS or through your Social Media, Email on the Desktop & Mobile site and even via WhatsApp by using Cozy Stay App / Cozy Stay Website, that will direct Referee to download the Cozy Stay App from Google Play Store or iOS App Store to get himself/herself register as Cozy Stay user.
  3. When the Referee, who had registered through using your referral link, becomes part of your Cozy Stay referral circle and pays the initial rent payment and moves into the property, the Referee shall receive an amount in cozy wallet upon next login.
  4. Rewards under this program shall be given in the form of Cozy wallet money to the Referral. Usage/redemption of e wallet money will be subject to the following terms and conditions:

    4.1 Cozy wallet can be used only for making a purchase of the services or using for service partner service on the Cozy Stay app/Cozy Stay Website. These cannot be taken as cash-back or transferred to a bank account.

    4.2 Cozy wallet money cannot be transferred from one Cozy Stay account to another.

    4.3 This amount needs to be redeemed within 365 days from the day they become active.

    4.4 Cozy Stay reserves the right to change/modify these usage criteria. In that event, the user shall be notified.
  5. Any fraud or abuse concerning the program is subject to strict administrative and/or legal action by us, including but not limited to the reversal of referral reward and/or termination of membership. A fraud encompasses:

    5.1 If a user is found referring to himself/herself using multiple IDs or phone numbers.

    5.2 If a user is found making multiple successful referrals and redeeming his/her referral rewards and then a majority of his/her Referees return/cancel their orders.

    5.3 Any other attempt to take unfair advantage, as deemed by us, of the Referral Program.
  6. Participation in the Cozy Stay Referral Program may require you to submit personal information about you and the users you refer, such as name and email address. You agree to receive communications from us with regard to your participation in the Cozy Stay Referral Program, and to allow us to communicate with your friends about your participation (for example, by disclosing to your friends that an invitation was sent by you). Any information collected from you or your referred users as part of the Cozy Stay Referral Program shall be subject to Cozy Stay's Privacy Policy.
  7. Contact Information
    7.1 For the purpose of the offer, any data shared with Company will only be used to refer the Company's services to the contacts available on the customer's device, upon such customer according to express permission to Cozy Stay to access its phone directory. By way of such express permission, the customer allows the Company to send referrals to contacts on such customer's phone book for the usage of the Cozy Stay app. Customer agrees that Company, in accordance with the Privacy Policy, may collect and use technical data such as its IP address, device ID, usage data and related information, including but not limited to technical information about the mobile device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to the customer related to the Cozy Stay App. Customer further agrees and guarantees that on its acceptance to participate in the Offer, it has expressly consented to the Company to collect, use and share certain information regarding the contacts contained in the customer device's phone book ("Contact Information'') with other users in accordance with the Privacy Policy in order to provide the benefits of the offer. Customer expressly acknowledges and agree that in order to avail of the offer and to enable the Company to provide the benefits thereunder, Company may periodically access the Contact Information to find and keep track of mobile phone numbers and other information of other users of the offer. By allowing Contact Information to be collected, customers give the Company a right to use that Contact Information and guarantees that it has any and all permissions required to share such Contact Information with the Company. The customer retains the right to opt-out to prevent the sharing of Contact Information at any time.

    7.2 Upon customer's consent, the customer's Contact Information shall be synced with Cozy Stay App / Cozy Stay Website. Post such sync, the customer would be able to view its contact list on the Cozy Stay App / Cozy Stay Website - whether such contacts are existing registered Cozy Stay customers' or not. In case any of the contacts are not registered, the customer shall have the option of inviting such contacts to use the Cozy Stay App / Cozy Stay Website.

    7.3 The offer is protected by intellectual property laws. The company shall retain ownership in and to the offer and to all related intellectual property rights, including without limitation trademarks, trade names, database rights. You are granted only a limited right to avail of certain defined benefits vide this offer, subject to these terms and conditions.

    7.4 Company hereby excludes, to the fullest extent permitted by law, any and all liability which may arise from customers sending messages/invites to its contacts or other third parties, including but not limited to, any action or claim regarding spamming.

    7.5 Customer's right to avail the benefits under the offer shall continue until such time that Company, at its sole discretion and without the obligation of notice, terminates the offer. The customer may terminate these at any time by uninstalling the Cozy Stay App. These terms will automatically terminate if the Customer fails substantially to comply with them. Upon termination by customer, or by Company due to customer's breach of these terms, the customer may not be entitled to any outstanding benefits of the offer.

    7.6 These terms and conditions must be read in conjunction with the other terms and conditions of the usage of the Cozy Stay App / Cozy Stay Website.
  8. We may terminate your eligibility for a referral program or terminate your account, or the accounts of Cozy Stay members you refer if you or they take any of the following actions:

    8.1 Open multiple accounts, including different email addresses, for the same person in order to generate additional referral rewards.

    8.2 Refer customers using spam, display advertising, sponsored links, unsolicited e-mails, or links on message boards or forums.

    8.3 Use false names, impersonate other people, or otherwise provide false or misleading information to us.

    8.4 Offer incentives to others to sign-up with Cozy Stay using your referral code.

    8.5 Violate these terms or any other terms and conditions on Cozy Stay.

    8.6 Participate in the Cozy Stay Referral Program where doing so would be prohibited by any applicable law or regulations.
  9. We reserve the right in our sole discretion at any time and without prior notice to you to add to, remove or otherwise change the terms of this program, including but not limited to:

    • Modifying the amount of the referral rewards.
    • Modifying the eligibility criteria for the Referee and/or the Referrer.
    • Modifying when the referral reward is given to the Referee and/or the Referrer.
    • Modifying how you may use the referral rewards earned through this program.
    • Requiring minimum purchase amounts for the redemption of referral reward.
    • Instituting a cap on the maximum number of successful referrals for which the Referrer earns rewards.
    • Modifying the maximum amount of referral rewards that one may earn.
    • Discontinuing the Cozy Stay Referral Program entirely.
  10. We shall post an updated version of these terms on the Cozy Stay App, and you shall be deemed to have accepted such changes by continuing to use the Cozy Stay App or the Cozy Stay Referral Program after the date such changes are posted.
  11. This is a limited period offer and is subject to change, at the sole discretion of Cozy Stay.
  12. Cozy Stay reserves the right to amend, modify, cancel, update or withdraw this Program at any time without notice. Upon such premature suspension, inconvenience, cessation, withdrawal, termination or closure by the Company, no person shall be entitled to claim loss of any kind whatsoever.
  13. This program is valid only on Cozy Stay mobile applications (on Android, iOS and Windows platforms) and on Cozy Stay Website and no other website/mobile application.
  14. Customers agree to be bound by these “Terms and Conditions”, the “Terms of Use”, “Privacy Policy” and other relevant documentation that are available on Cozy Stay Mobile App/website including any modifications, alterations or updates that we make.
  15. All disputes arising out of the referral program shall be subject to the exclusive jurisdiction of the Courts in Kochi, Kerala.

Cancellation of Policy

APPLICABILITY OF POLICY

(A) By agreeing to use the Platform and/or placing a request for fulfillment of Services on the Platform, you agree to be bound by the terms contained in this Policy without modification. If you do not agree to the terms contained in this Policy, you are advised not to transact on the Platform.

(B) Please note that we may from time to time change the terms of the Policy that govern your refund and cancellation of an order for Products on the Platform. Every time you wish to use the Platform, please check the Policy to ensure you understand the terms and conditions that apply at that time.

A. Cancellation Policy

The Cancellation, return and refund policy laid down by Cozy Stay is for the sole purpose of regulating cancellations and refunds for co living hospitality services. Users agree to the following cancellation and refund policies while using the web application or app (collectively, “the app”).

1. Booking Rooms :



1.1 Hospitality Services

Users can create an account and schedule a visit to the property or view it through the platform. After confirmation, they may click on book and select a move-in date. In the event ‘move in’ is cancelled but a deposit is put in, it shall be refunded as per refund policy. Users can click on the “My bookings” sections to check the status.

1.2 Cozy Stay Cancellation

There may be certain orders that Cozy stay is unable to accept and service and these may need to be cancelled. Some situations may result in service being non-available. Cozy stay also reserves the right to cancel stays in the event that falsified information has been provided to the Company

Refund Policy

1. When can I expect the amount to be refunded?

1.1
You understand that it is mandatory to inform with regard to vacating the premises prior to 15 days. After vacating the premises the amount shall be deposited in the account of the user within 3 - 7 business days

1.2
In certain situations such as if You inform us about vacating the property not prior to 15 days, a certain amount shall be deducted from the security deposit submitted by you and the rest shall be refunded. In case any damages occur to the property while you reside there, when you vacate the property, the Company shall accrue an amount for the damages from the security deposit and if any amount is remaining it shall be refunded. If the damage amount exceeds that of the security deposit, then the Company shall accrue it from the security deposit and an extra charge shall be levied on the resident while vacating.

1.3 Booking :
1.3.1 This provision is with respect to the refund of booking. In the event of cancellation of a booking, the amount shall be refunded to the user if he/she cancelled the booking 3 days prior to the move-in date. This is non negotiable.

1.3.2 If the user has booked a room in the establishment and paid the initial amount for booking, then in the event of cancellation before 3 days of moving in, the full booking amount shall be refunded to them within 3-7 business days. If the booking has been cancelled prior to the joining date, then the user is not eligible for return of their booking amount.

1.3.3 In the event of cancellation of moving and if the user has submitted a total booking as well as rent amount + security deposit, then the user shall be refunded the total amount if he/she cancels prior to 15 days before the joining date.

1.3.4 If he/she cancels between 15 th day to 3rd day prior to moving in, then 1000 rupees shall be deducted from the total and be refunded. This amount is for processing fee accrued to Cozy Stay.

1.3.5 If he/she cancels prior to 2 days of joining after paying the full amount for the stay, the company shall deduct a processing fee amounting to half of the rent paid and the user shall be refunded with the full security deposit and remaining amount of rent.

1.3.6 In the unfortunate event of cancelling the stay after moving in, the user shall only receive the security deposit submitted. The rent shall be retained and the remaining shall be refunded.

1.4 Please note that the refund amount mentioned at the time of cancellation on the Platform is an estimate and will be finalised after completion of verification. A refund of the total amount paid for booking services returned to you.

1.5 Refunds will be initiated only post successful verification of the service provider or intermediary property owners. Please note that the verification process may take 48 hours from the time of cancellation.

1.6 The amount is expected to reflect in your account after completion of verification from the service provider as per the following timelines:

1.7 You understand and acknowledge that we reserve the right to claim back any refund that has been processed by us as a result of fraudulent activities such as damages to property or any similar activity.
